BanyanEffective October 17, 2026
These Terms are an agreement between you and Banyan (operated by Nicholas Wang, Los Angeles, California). By creating an account you agree to them and to the Privacy Policy. If you don’t agree, please don’t use Banyan.
Banyan helps people find partners to exchange or practice languages. It is not a dating service, a tutoring service, or a guarantee that you will learn anything — that part is up to you and your partner.
You must be at least 18 years old. You may have one account, tied to your own phone number, and the information in your profile must be true and about you. Photos must be of you.
Everything you post — photos, prompts, messages, voice notes — remains yours. You give us permission to store it, show it to the members you choose to interact with, and process it as described in the Privacy Policy, for as long as your account exists.
Don’t post anything you don’t have the right to share, anything sexual, hateful or violent, or anything that reveals another person’s private information.
Be kind and be honest. Specifically, don’t: harass, threaten or discriminate; pretend to be someone else or misstate your language level; ask other members for money, gifts, codes or personal documents; use Banyan to advertise, recruit or sell; message in bulk or run automated tools; or try to get around a block, a limit, or a removal.
Report and block anyone who makes you uncomfortable. We may read a reported conversation to decide what to do, and we can warn, restrict or remove accounts at our discretion.
Some members choose to practice face to face. If you do, you do so at your own risk. Meet in public places, tell someone where you’re going, and trust your instincts. Banyan does not run background checks and is not responsible for what happens offline.
To keep conversations meaningful we limit things like how many likes you can send per day and how many active chats you can have. These limits, and the features of Banyan, may change over time. We may also suspend or stop the service, with notice where we can give it.
You can delete your account whenever you like in Settings. We can suspend or remove accounts that break these Terms, put others at risk, or that we are required to remove by law.
Banyan is provided “as is”. We don’t promise it will be uninterrupted or error-free, or that anyone you meet is who they say they are. To the fullest extent the law allows, we disclaim warranties of every kind.
To the fullest extent the law allows, Banyan and its operator are not liable for indirect, incidental or consequential damages, or for anything arising from your interactions with other members, online or offline. Our total liability to you for any claim is limited to the amount you paid us in the past twelve months, which, while Banyan is free, is zero.
These Terms are governed by the laws of the State of California. If we have a disagreement, write to us first at trybanyan@gmail.com and we’ll try to sort it out. Otherwise, disputes will be handled in the state or federal courts located in Los Angeles County, California.
We may update these Terms. For meaningful changes we’ll tell you in the app first; continuing to use Banyan after that means you accept the new version.
